How it is calculated

  • With 80% attendance over a year you get 15 days. In the first year, or with under 80% attendance, you get 1 day for each month of full attendance (Labor Standards Act art. 60(1)(2)). Since 29 May 2018 the first-year monthly days are no longer taken off the 15 days.
  • From 3 years, 1 day is added for every 2 years beyond the first, up to 25 days a year (art. 60(4)).
  • Leave arises the day after a month or a year is completed, and only if you are still employed that day (Supreme Court 2021da227100; Ministry guidance of 15 December 2021).
  • Leave not used within a year expires; first-year monthly leave must be used before the first anniversary (art. 60(7)). Pay for expired leave can be claimed from the next day, unless the employer lawfully urged you to use it (art. 61). Leave you could not use because of the employer does not expire.
  • Calendar-year basis: on 1 January after joining you get a share for the first year. The Ministry describes it only as proportional to service in the year you joined; this tool uses 15 × days employed that year ÷ 365 (or the days in that year). After that, each 1 January counts the full years of service on that day.
  • Workplaces with 4 or fewer workers and workers under 15 hours a week get no annual leave (Enforcement Decree, Table 1; art. 18(3)).
