How it is calculated

  • Leave pay = unused hours × hourly ordinary wage, that is unused days × daily ordinary wage (Labor Standards Act art. 60(5); Enforcement Decree art. 6(3)). For part-time workers, unused leave hours × hourly wage (Enforcement Decree, Table 2).
  • While employed, leave that expires unused is paid on the next payday. On leaving, all unused leave is paid within 14 days, including the 15 days that arise if you work through the day after a full year (Supreme Court 2003da48549).
  • If the employer lawfully urged use in writing at the set times and the leave expired, no pay is owed (art. 61). Leave cut short by leaving is still paid.
  • Leave pay is a wage: claims expire after 3 years, and late payment carries 20% a year interest (arts. 49 and 37).
  • Workplaces with 4 or fewer workers and workers under 15 hours a week have no annual leave, so no leave pay (Enforcement Decree, Table 1; art. 18(3)).

The pay month used is usually the last month the leave could be used; company rules may use the average wage instead. Amounts under 1 won are rounded. This is a guide, not legal advice.
